I. The City Charter of Baltimore makes no r eference to population as a basis for the
election of Councilmen and has no provision for redistricting. The boundaries of the
councilmanic districts are in the Charter, and no provision is made for updating them
on t he basis of population flux. The six districts are described by ward and precincts.
II. The 1962 Baker v. Carr ruling of the Supreme c-,urt that "one man, one vote" shall
be the absol ute criterion for each citizen 1 s v~ting privilege and the Voting Act of
1965 have required continuous study of voting districts. The present City Council reflects past changes caused by the implementation of these efforts to make election
procedures democratically valid . The Council.rnanic districts can be made t0 conform to
the "one man, one vote" concept by c1.1urt tests or petition drives, but these procedures
should be unnecessary.
The January 19G9 voter registration figures for Baltimore indicate that one district bas 7cc/a more registered vot er s than another district . It would be reasonable to
assume that ther e is a significant population variance also.
The latest Supreme Court ruling on equitabl e election districts rejected deviations from the average population of as little as three percent.
Redistricting must be assured in order to guarantee the most basic civil right,
the right to an equal vot e .
III. Therefore, it is proposed that requirement for mandat ory City Council redistricting after each decennial census be included in the City Charter, with the Mayor required to institute t he change, and with these three criteria :
1. The overriding consideration fer redistricting is that all the districts
have an equal population.
2. The next consideration is that the districts should be as compact as possible. (This is advantageous to those running for office as well as to
those voting. It is easier to campaign in a compact district, and communication is easier. The identity of neighborhoods could be better reflected
in their choice of representatives. The power of block voting could be
exercised . )
3. The district, after meeting the above criteria, should be in keeping, as
far as possible, with the historical alignment. (This also would be advantageous to both in that they would be less likely to have to re-crient themselves.)
This redistricting should result in districts of equal population, compact and,
after meeting these conditions, closest to the present districts .
With this requirment and criteria for redistricting included in the City Charter, the Mayor could institut e the change by commission or by computer. Redistricting
has been done successfully by computer, for example, in Delaware . This w~uld be
quick, impersonal, and accurat e . Perhaps a commission could oversee the computer
operation.
A time limit should be placed on the redistricting effort. It w~uld be possible
to have it accomplished in thirty days from the time of the official announcement of
the census . The present census study should have results by August, 1970. Therefore it would be possible, if this amendment were to be placed on the November
ballot, for redistricting to be accomplished this year.
